California requires clinicians keep final say and bias checks on clinical AI
Gov. Gavin Newsom signed a package of AI bills on September 30, 2026, including AB 1979 and SB 503. AB 1979, sponsored by the California Nurses Association, guarantees licensed clinicians can exercise their own professional judgment over care decisions informed by AI clinical-decision-support tools and extends medical confidentiality protections to patient data accessed through health chatbots, with exemptions for AI used in documentation. SB 503 requires developers and deployers of medical clinical decision support systems to make reasonable efforts to identify and mitigate known or foreseeable bias in their systems. The same day, Newsom vetoed separate bills that would have protected clinicians from retaliation for overriding AI recommendations and further restricted AI in mental health care.
Why it's notable: California is the first state to legally guarantee clinicians the final call over AI-informed care decisions and to require bias monitoring of clinical decision-support software, a template compliance teams at other health systems are likely to watch.
